Tim has over 15 years of experience in complex commercial litigation and appellate matters, encompassing a wide variety of intellectual property, securities, products liability and general business issues. His intellectual property experience includes patent and trade secret litigation, copyright litigation and counseling, and all aspects of trademark and unfair competition practice. He has represented a number of clients in the telecommunications, technology and computer industries.

Tim has also represented public and private companies, officers, directors and other individuals with respect to a variety of securities matters, including SEC and FBI investigations, SEC enforcement actions and receiverships, special litigation committee investigations, and shareholder derivative litigation. His securities experience includes claims related to Ponzi schemes, Prime Bank schemes, insider trading, fraud, waste and misappropriation of corporate assets, and improper revenue recognition.

Representative Experience

• Board of Regents of the University of Texas, et al. v. Nippon Telegraph and Telephone Corp. (W.D. Tex.). Represent NTT in litigation pending in the Western District of Texas where the claims involve the rights to lithium battery technology patented in the US and Japan. Plaintiffs allege that the technology at issue will become the predominate power source for cellular phones and that the damages for interfering with their patent rights exceed $500 million.
• Azoteq PTY Ltd. v. Photonlight.com, Inc., et al. (N.D. Tex.). Represented the defendants in patent infringement case involving the interaction between microchip processors and portable electronic devices. Case settled prior to trial.
• Sanijet Corp. v. Beauty Mall, Ltd., et al. (N.D. Tex.). Represent defendant in patent infringement case involving spa technology.
• Provided non-infringement opinion to developer of telephone switching firmware/hardware with respect to competitor's intellectual property.
• Represented defendant start-up Internet telephony company in litigation over exclusive acquisition rights. Defendant's business used the Internet to carry long distance voice traffic and to provide "click-to-talk" capability to Internet users such that companies could speak directly with customers through commercial websites. Case settled prior to trial.
• Represented banking industry software company as plaintiff in trade secret litigation against a competitor. Defendants agreed to temporary injunction, and the Dallas Court of Appeals affirmed a permanent injunction and damages awarded to our client as death penalty sanctions.
• Represented telecommunications staffing company in trade secret litigation against former employee and competitor. Obtained temporary injunction, case settled before trial.
• Represent the former network division president of publicly traded telecommunications company in SEC investigation.
• Represented Japanese technology company in litigation relating to the installation of fiber optic cable system. Case settled prior to trial.
