Margaret’s practice focuses on representing employers in multi-state employment litigation matters and providing counseling to management/human resources on a variety of employment practice concerns. Margaret’s litigation experience includes defending employers in federal and state courts, in arbitration and mediation forums, and before administrative agencies. She has experience on a wide range of claims, including:

  • Title VII, ADA, FLSA, ADEA, FMLA, and Sarbanes-Oxley Act;
  • State anti-discrimination statutes;
  • Wrongful/retaliatory discharge;
  • Breach of employment agreement/breach of non-compete, non-disclosure, and non-solicitation covenants; and
  • Employment-related torts such as defamation, interference with business relations, intentional infliction of emotional distress, and negligent hiring and supervision.

The employment counseling aspect of Margaret’s practice involves:

  • Providing proactive advice to minimize the risk of litigation and workplace disputes;
  • Reviewing employment issues in connection with corporate mergers/acquisitions or down-sizing;
  • Reviewing personnel handbooks, policies, and procedures;
  • Analyzing multi-state and federal wage and hour matters;
  • Analyzing multi-state and federal employee privacy issues; and
  • Investigation of discrimination, harassment, and retaliation complaints.

Briefings, Seminars & Speeches

  • Authored “Aids in the Healthcare Workplace,” presented to the National Business Institute’s Nursing Law in Texas.
  • Co-Authored "What to do When the Whistle Blows: Practical Tips for Handling Whistleblower Complaints," presented to the Women Presidents' Organization in October 2006.
