We help major insurance companies navigate through complex coverage issues involving single and multiple plaintiff cases and class actions.
Skilled support for insurance carriers
We represent insurers in disputes at both the trial and appellate levels, and have the industry knowledge to focus on specific types of insurance. As an example, for nearly 20 years we’ve worked with a major insurer in hundreds of lawsuits filed by individuals, medical providers and former customers against the company’s managed care business.
Most recently, we defended an insurer being sued by a former corporate customer for more than $300 million in alleged loss of goodwill and related tort damages. After a nine-day trial in Houston federal court, we secured a jury verdict rejecting all of the former customer’s claims.
Comprehensive counsel in complex cases
We frequently represent insurers in complex disputes, from inception through trial and appeal. When a major insurer and some of its managed care affiliates chose us to represent them in a federal court challenge to the State of Texas’ HMO Health Care Liability Act, our successful efforts spanned five years and resulted in three published opinions from the U.S. Fifth Circuit Court of Appeals. The result was a very favorable construction of the Act that benefited all of our insurance company clients.
Success at class action defense
Insurance companies are often the targets of class action lawsuits, and we have prevailed in defense of a number of carriers against class claims. We represented insurers defending against plaintiffs that sought class certification in ERISA breach of fiduciary duty and Lanham Act suits. Our lawyers also defended insurance companies in antitrust suits brought by health care providers, as well as in Federal Trade Commission matters.
